Terms of Service

These terms apply to the 2beShared app and the website 2beshared.com (together "2beShared"), provided by Frank Haubenschild, Erlenstrasse 39a, 57234 Wilnsdorf, Germany (see Impressum). By creating an account or using 2beShared you agree to them.

1. The service

2beShared lets you save links, videos and places into a personal library, organize them with notes and tags, share them with friends and via share links, and discover public items from other people. 2beShared is free of charge.

2beShared is currently in a test phase. Features may change, be added or removed, and the service may occasionally be unavailable. We don't guarantee a specific level of availability.

2. Your account

• You must be at least 16 years old to use 2beShared.
• Keep your sign-in details secure; you're responsible for activity on your account.
• Your @handle must not impersonate others or infringe anyone's rights.
• You can delete your account at any time in the app under Profile → Settings, or as described on our account deletion page.

3. Your content

You keep all rights to the notes, tags and other content you add. To run the service you grant us a non-exclusive, free, worldwide licence to store, process and display that content as needed to provide 2beShared — for private items only to you, for shared items to the recipients, and for public items to all users, who can also save a copy of a public item into their own library. The licence ends when you delete the content or your account, except for copies already shared with or saved by others.

You're responsible for what you save, share and publish, and you confirm that you have the right to do so.

4. Rules of conduct

Don't use 2beShared to share or publish content, or behave in a way, that:

• is illegal, or infringes copyrights, trademarks or other rights of others;
• is hateful, discriminatory, harassing, threatening or glorifies violence;
• is sexually explicit, or endangers minors in any way;
• is spam, fraud, phishing or malware, or misleads others;
• violates other people's privacy, for example by sharing their personal data without consent;
• interferes with the service, for example by automated mass access or by circumventing security measures.

5. Reporting and moderation

You can report any public or shared item from its menu in the app, or by email to info@2beshared.com. We review reports manually. If content breaks the law or these terms, we may remove it or make it private, restrict features, or suspend or delete the account — choosing the measure that is proportionate to the violation. We tell affected users which measure we took and why, and you can contest a decision by replying to that message or writing to us at the address above.

6. Third-party content

Items link to websites, videos and maps of third parties. We don't control them and aren't responsible for their content. Their own terms apply when you open them.

7. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we are liable only for breaches of essential obligations — obligations whose fulfilment makes the proper use of 2beShared possible in the first place and on which you may regularly rely — and limited to the typical, foreseeable damage. Otherwise our liability is excluded. Since 2beShared is free, keep your own copy of anything that's important to you.

8. Ending use

You can stop using 2beShared and delete your account at any time. We may end the service or your account with reasonable notice, and immediately for serious or repeated violations of these terms.

9. Changes to these terms

We may update these terms, for example when features or legal requirements change. We'll inform you of material changes in advance in the app or by email. If you don't agree, you can delete your account before they take effect.

10. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you're a consumer, mandatory consumer-protection rules of the country you live in remain unaffected.
